Terms of Service

1. Acceptance of Terms

By creating an account or using PlotPal ("the platform", "we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the platform. These terms form a binding agreement between you and PlotPal.

2. Who Can Use PlotPal

PlotPal is intended for genuine residents and lot owners within supported residential estates in Australia. To use the platform you must:

• Be 18 years of age or older
• Be located in Australia
• Be the owner, purchaser, or authorised occupant of a lot within a supported estate
• Provide accurate and truthful information when registering and verifying your lot

We reserve the right to decline or revoke access to anyone who does not meet these requirements.

3. Account Registration

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. You must notify us immediately if you suspect unauthorised access to your account. You may not create an account on behalf of another person without their explicit consent.

4. Lot Verification

To access community features, you must complete our lot verification process by submitting a supporting document — such as a contract of sale or council rates notice — confirming your association with your nominated lot. By submitting a verification document, you confirm that:

• The document is genuine and relates to you
• You are the owner, purchaser, or an authorised occupant of the nominated lot
• You consent to PlotPal staff reviewing the document for verification purposes

Submitting a false or altered document is a serious breach of these terms and may result in immediate account suspension and referral to relevant authorities. Verification documents are deleted within one month of approval, as described in our Privacy Policy.

If you sell your lot or are no longer an occupant, you must notify us and your verified status may be removed. You must not use the platform to access community features for a lot you no longer own or occupy.

5. Build Stage Information

Build stage information shown on the platform is self-reported by residents. PlotPal does not verify build stages against council records or builder data. This information is provided for community interest only and should not be relied upon for any legal, financial, or construction planning purpose.

6. Community Features and User Content

PlotPal provides community features including a community feed, direct messaging, and a resident hub. When you post content or send messages through the platform, you retain ownership of that content but grant PlotPal a non-exclusive, royalty-free licence to store and display it for the purpose of operating the platform.

You are solely responsible for the content you post or send. You must not post or send content that:

• Is false, misleading, or defamatory
• Harasses, threatens, or intimidates another person
• Discloses another person's private information without their consent
• Is discriminatory on the basis of race, gender, religion, disability, or any other protected attribute
• Promotes illegal activity
• Infringes the intellectual property rights of another party
• Is spam, advertising, or unsolicited commercial content

We reserve the right to remove any content that breaches these terms, without notice.

7. Reporting and Moderation

PlotPal provides a reporting tool for residents to flag content or conduct they believe violates these terms. Reports are reviewed by PlotPal staff. We will take action we consider appropriate, which may include removing content, issuing warnings, or suspending accounts. We are not obligated to take any specific action in response to a report, or to disclose the outcome to the reporter.

8. Suspension and Termination

We may suspend or permanently terminate your account at our discretion if you breach these terms, submit a fraudulent verification document, engage in conduct harmful to other residents or to the platform, or if we reasonably believe your account poses a risk to others. You may close your account at any time through your profile settings. On account closure, your personal data will be deleted within 30 days as outlined in our Privacy Policy.

9. Intellectual Property

All platform design, software, branding, estate map data, and content produced by PlotPal is owned by or licenced to PlotPal and may not be reproduced, copied, or distributed without our written permission. The PlotPal name and logo are our property.

10. Limitation of Liability

To the maximum extent permitted by law, PlotPal is not liable for any indirect, incidental, or consequential loss arising from your use of the platform, including loss of data, loss of opportunity, or damage resulting from content posted by other users.

Nothing in these terms limits or excludes any rights you may have under the Australian Consumer Law, including any consumer guarantees that cannot be excluded by agreement.

PlotPal does not guarantee uninterrupted access to the platform and accepts no liability for outages, data loss, or errors resulting from third-party services including our hosting, mapping, and database providers.

11. Privacy

Our collection and handling of your personal information is governed by our Privacy Policy, which forms part of these terms. By using PlotPal, you consent to our collection and use of your personal information as described in that policy.

12. Changes to These Terms

We may update these terms from time to time. If we make material changes, we will notify you by email or via an in-platform notification. Continued use of PlotPal after changes take effect constitutes your acceptance of the updated terms.

13. Governing Law

These terms are governed by the laws of Queensland, Australia. Any dispute arising from these terms or your use of the platform will be subject to the exclusive jurisdiction of the courts of Queensland.
